MANGO and WT FASHION may collect from your relationship and use of our services, the following data and/or data categories: i) identification and contact data; ii) personal data; iii) financial data, such as credit card data (PAN+CVV2), in compliance with PCI DSS standards, which will be used for payment processing whenever you purchase any of our items or, in the case of returns for transfers, the account number for which we need to process the refund of your purchase; iv) user data of the MANGO website or app and browsing, in accordance with the cookies policy.

It is necessary for us to collect and process your personal data. If you do not provide us with your personal data, we will not be able to effectively provide our products to you or process your personal data for any of the purposes describe under this policy.

When processing your personal data for the purposes described above, WT FASHION may transfer and further process your personal data in a jurisdiction outside of Malaysia. We will ensure that your personal data will be transferred and subject to a similar level of protection required by applicable data protection laws, including the Malaysian Personal Data Protection Act 2010 (“PDPA”).

Your personal data will be processed for the following purposes, whichever apply:

A) CREATION OF A USER ACCOUNT

Manage your registration, which will involve the creation of a MANGO user account. This account will allow you to centralise any issue relating to your user status, and give you access to certain functions available and reserved for those with said status. For example, having a user account will allow you to store certain information that may be used in future purchases and/or interactions with MANGO.

• The lawful basis for processing your data for this purpose is the execution of a contract understanding as such the Conditions of Sale accepted.

B) PURCHASE OF MANGO PRODUCTS

Process the purchase of items via the different purchasing channels enabled by MANGO and WT FASHION. This procedure consists in taking all appropriate steps in order to manage your purchase and, wherever applicable, guarantee the correct delivery of your order, in addition to undertaking any procedure related to the sale of the item and, wherever applicable, managing the return of items.

To do this, we will be able to send you information about the status of your purchase by e-mail, SMS and/or any other channel available at any moment.

• The lawful basis for processing your data for this purpose is the execution of a contract, understanding as such the Conditions of Sale accepted at the moment of purchasing the items. The processing of your data is necessary in order to guarantee the fulfilment of the rights and obligations contained in the Conditions of Sale.

In cases where you are registered as a user and purchase one of our items via the website or app, we may carry out the following data processing:

Save your credit card details for use in future purchases.

• The lawful basis for the processing or your data is the express consent given by you for us to save this information for use in future purchases, without prejudice to the legitimate use of your credit card data in the execution of a contract, in line with what is indicated in the previous section. 

To show you as a priority recommendations of similar content, in accordance with your purchase history or browsing on our website or app.

• The lawful basis for the processing of your browsing data is the express consent given by you when accepting the cookies. Furthermore, in order to analyse your purchase history, after balancing your interests as the affected data subject, and those of MANGO as the data controller, it has been determined that the lawful basis that legitimises the processing or your data is a legitimate interest, deeming that it is in the interest of all the parties involved that items which may be of interest to the consumer are shown as a matter of priority. In this way, showing items that may reflect the priorities of the user in question as a matter of priority will allow MANGO to offer you a better quality service and a more positive user experience, while giving MANGO a reputational benefit based on the fact that users will have a positive browsing and shopping experience on our website and app.

C) CONFIGURE YOUR RELATIONSHIP WITH MANGO AS A BRAND

Newsletter: management and sending of information on exclusive promotions and new products adapted to your profile, sending of audiences via digital platforms, and notifications relative to pending garments and accessories in your shopping bag via e-mail, SMS, post or any other communication channel and/or online platform. This includes promotional actions, such as, for example, the management of competitions and prize draws organised by MANGO. In cases where receiving commercial notifications via different channels is accepted, personal data may be used to personalise notifications via online means.

• The lawful basis for the processing of your data is the express consent you have given. Under no circumstances will the withdrawal of consent affect the lawfulness of the processing based on consent prior to withdrawal.

Management of the alerts service to notify the availability of garments and accessories on the web/app. 

• The lawful basis for the processing of your data for this purpose is the express consent given by you, which may be withdrawn at any moment without said withdrawal affecting the lawfulness of the processing based on consent prior to withdrawal.

Respond to the exercise of rights recognised in the data protection legislation.

• The legal basis for the processing of your data is the fulfilment of a legal obligation with regard to managing the exercise of rights, in accordance with the obligation contained in the General Data Protection Regulation. 

Attend to queries, requests and potential complaints you may make via the Customer Services channel. 

Depending on the reason you are contacting MANGO and/or WT FASHION, the lawful basis for the processing of your data may vary. Consequently:

• We consider that the controller has a legitimate interest in resolving and correctly attending to any suggestions, queries and requests you may make via the Customer Services channel on the understanding that, under no circumstances, will your rights and/or freedoms be affected or prejudiced by the fact that we are responding to a request initiated by you.
• In cases where this relates to an order that needs to be attended to in order for formalise the purchase, the lawful basis for the processing of your data is the execution of a contact, understanding as such the Conditions of Sale.
• In cases where your data is processed to attend to a complaint sent via the Customer Services channel, the lawful basis for the processing of your data is the fulfilment of a legal obligation contained in the General Law for the Defence of Consumers and Users.

Following the rendering of one of our services, sending you quality surveys aimed at knowing your opinion and degree of satisfaction with your relationship with MANGO and WT FASHION. The information collected from the survey will allow us to create and improve our services and procedures, said experience being of considerable interest to us. 

• The lawful basis for the processing of your data is a legitimate interest. Our legitimate interest consists of being able to guarantee you that our web/app is secure, and to help the controller understand the needs, expectations and your degree of satisfaction with the brand and therefore improve our services at all times. All these actions will be carried out to improve your degree of satisfaction and guarantee a unique browsing and shopping experience, via aggregated analysis.

Mango store search service. In cases where you are registered with your account, Mango will process your personal data in order to provide you this service, indicating the nearest stores to the address you have entered manually in the search engine enabled for this purpose on both the website and the app. 

• The lawful basis for the processing your location for this purpose is a legitimate interest. Our legitimate interests consists of being able to provide the requested service in the most precise and speedy manner, and consequently improve the services we provide via our web/app. All of these actions are carried out in order to improve your degree of satisfaction with the products and services offered by MANGO

In order to guarantee that the personal data are appropriate, pertinent and limited to what is necessary for the purposes for which they are processed, MANGO and WT FASHION will keep your personal data only for a period that is reasonably necessary to fulfil the purpose for which they were collected, given the requirements to respond to issues that are raised or to resolve problems, make improvements, activate services and fulfil the requirements of the applicable legislation. This means that we may keep your personal data for a reasonable time, including after you have stopped using the services of MANGO and WT FASHION and/or have stopped using the web/app. After this period, your personal data will be blocked in all MANGO systems for the sole purpose of making them available to the competent authorities in order to attend to any potential administrative or legal responsibilities and the exercise or defence of complaints. Once the blocking period for personal data has passed, they will be permanently deleted.

Your personal data will only be communicated to third parties in order to comply with any legal obligations that may apply in each case, for example, to Public Authorities and/or Bodies whenever required by the applicable legislation.

In cases where you make a purchase on our website or app, your data may be communicated, wherever applicable, to financial institutions and payment service providers, fraud detection and prevention organisations, and logistics, transport and goods delivery suppliers. Such communications are strictly necessary in order to guarantee the delivery of your order.

You are also informed that MANGO or WT FASHION may contract third parties that will have access to your data as the result of a service provision we have entered into. Such third parties may provide technology, marketing and advertising services, among others, and in all cases will process your data in accordance with the instructions of MANGO or WT FASHION and never for their own aims.

MANGO or WT FASHION shall not, under any circumstances, sell your personal data to third parties.

In certain services offered via the web/app, such as Gift Cards, the user (i.e. the gift giver) may provide personal information of the recipient (i.e. the gift receiver). In this case, MANGO and WT FASHION will also comply with its obligations in accordance with the provisions contained in the data protection legislation, processing them solely for the purpose for which they have been provided to us.

The web/app uses data security technologies such as firewalls, access control procedures and cryptographic mechanisms to prevent any unauthorised access to data and guarantee data confidentiality, and to conduct periodic security audits in order to carry out risk assessments and frequent controls. In order to achieve said aims, users accept that MANGO will obtain data for the purpose of authenticating access controls.

Furthermore, all transactions via the web/app will be made via secure payment systems. Confidential payment details are transmitted directly in encrypted format (SSL) to the corresponding entity.

MANGO declares that it has adopted all the technical and organisational measures necessary to guarantee the security and integrity of the personal data it processes, and to prevent the loss, alteration and/or unauthorised use of the same by third parties.

You have the following privacy rights, which may be exercised via the e-mail address personaldata@mango.com. In order to process your request to exercise your rights, we may ask you to provide proof of your identity.

This privacy policy will be available at all times. However, in cases where we modify the content of the same in a substantial and significant way, we shall notify you via the web/app or to your e-mail address, in order to comply with the duty of information contained in the GDPR and the  PDPA in Malaysia.

Consequently, if you wish, you may exercise your rights as a data subject.

This policy is issued in both English and Bahasa Malaysia versions in accordance with the local language requirement under Section 7(3) of the PDPA. In the event of inconsistencies or discrepancies, the English version shall prevail.

Cookies are files installed on the user's computer, phone, tablet or any other device, with the purpose of recording the user's activities during their browsing time on this website and/or the MANGO mobile application ("Web/App"). Through the use of cookies, it is possible for the server where the Web/App is located to recognize the browser used by the user, allowing, for example, the registered user to access areas and services without having to register on each visit and remember their language, country preferences, etc. on future visits. Cookies are also used to measure audience and traffic parameters, control progress and number of entries.

In relation to the concept of "Cookie", we also refer to other technologies similar to cookies that, in a similar way, allow storing or retrieving certain information from a device such as, for example, flash cookies, web beacons or bugs, pixels, HTML5 (local storage), and SDK technology for App formats, as well as the use of fingerprinting techniques to identify the device of the interested party.

During access and navigation on the website or through the use of the mobile app, MANGO may store or record IP addresses, user preferences or the type of device used for the main purposes of (i) compiling statistics related to the number of visits or web traffic; (ii) offering a more personalized browsing experience; and (iii) remembering sign in data, even on different devices, and (iv) displaying advertising, on this page or others, based on browsing habits within our website.

Similarly, we do not store sensitive personal identification information such as your address, your password, etc., in the cookies we use.

MANGO will retain the personal data collected only for the specified, provided, and limited period necessary to fulfill the purpose for which they were collected, as well as to comply with the requirements of applicable legislation. Once the intended purpose is fulfilled, your data will be properly blocked for the period during which legal actions may arise and, once the prescription period has passed, they will be properly deleted.

Similarly, the data obtained through the use of cookies accepted by the user will be kept for a period of 13 months and, consequently, once this period has passed, a new consent will be requested when you visit our WEB/APP.

Regarding the third parties identified in the cookie settings panel, you can consult their retention period in their respective privacy policies.

Generally, data processing is carried out by service providers located within the European Economic Area or in countries that have been declared to have an adequate level of protection.

In the event of international data transfers to countries that do not have a decision of adequacy from the European Commission, MANGO will use the Standard Contractual Clauses adapted by the European Commission as a guarantee for those transfers in compliance with Items 44 to 49 of the 2016/679 Data Protection Regulation. In any case, the third parties with whom personal data is shared will have previously accredited the adoption of adequate technical and organizational measures for the correct protection of the data.

B) PEMBELIAN PRODUK MANGO

Proses pembelian barang melalui pelbagai saluran pembelian yang disediakan oleh MANGO dan WT FASHION. Prosedur ini melibatkan pengambilan langkah-langkah yang sesuai untuk menguruskan pembelian anda dan, jika berkenaan, menjamin penghantaran yang betul bagi pesanan anda, di samping itu melaksanakan sebarang prosedur yang berkaitan dengan penjualan barang dan, jika berkenaan, menguruskan pemulangan barang.

Untuk melakukan ini, kami akan dapat menghantar maklumat tentang status pembelian anda melalui e-mel, SMS, dan/atau mana-mana saluran lain yang tersedia pada bila-bila masa.

• Asas yang sah untuk memproses data anda untuk tujuan ini adalah pelaksanaan kontrak, persefahaman seperti Syarat-syarat Penjualan yang diterima pada masa pembelian barang. Pemprosesan data anda adalah perlu untuk menjamin pemenuhan hak dan kewajipan yang terkandung dalam Syarat-syarat Penjualan.

Dalam kes di mana anda berdaftar sebagai pengguna dan membeli salah satu barangan kami melalui laman web atau aplikasi, kami mungkin melaksanakan pemprosesan data berikut:

• Asas sah untuk pemprosesan data pelayaran anda adalah persetujuan nyata yang diberikan oleh anda semasa menerima kuki. Selain itu, untuk menganalisis sejarah pembelian anda, setelah mengimbangi kepentingan anda sebagai subjek data yang terlibat dan kepentingan MANGO sebagai pengguna data, telah ditentukan bahawa asas yang sah yang melegitimasi pemprosesan data anda adalah kepentingan sah, dengan menganggap bahawa ia adalah dalam kepentingan semua pihak yang terlibat bahawa item yang mungkin menarik minat pengguma ditunjukkan sebagai keutamaan. Dengan cara ini, menunjukkan item yang mungkin mencerminkan keutamaan pengguna sebagai keutamaan akan membolehkan MANGO menawarkan perkhidmatan yang lebih berkualiti dan pengalaman pengguna yang lebih positif, sambil memberikan manfaat reputasi kepada MANGO berdasarkan fakta bahawa pengguna akan mempunyai pengalaman pelayaran dan pembelian yang positif di laman web dan aplikasi kami.

Surat Berita: pengurusan dan penghantaran maklumat mengenai promosi eksklusif dan produk baharu yang disesuaikan dengan profil anda, penghantaran khayalak melalui platform digital, dan pemberitahuan berkaitan pakaian dan aksesori yang belum selesai dalam beg beli-belah anda melalui e-mel, SMS, pos atau mana-mana saluran komunikasi dan/atau platform dalam talian. Ini termasuk tindakan promosi, seperti, misalnya, pengurusan pertandingan dan cabutan hadiah yang dianjurkan oleh MANGO. Dalam kes di mana penerimaan pemberitahuan komersial melalui pelbagai saluran diterima, data peribadi mungkin digunakan untuk memperibadikan pemberitahuan melalui kaedah dalam talian.

• Asas yang sah untuk pemprosesan data anda adalah persetujuan nyata yang telah anda berikan. Dalam apa jua keadaan, penarikan balik persetujuan tidak akan menjejaskan kesahihan pemprosesan berdasarkan persetujuan sebelum penarikan balik.

• Dasar undang-undang untuk pemprosesan data anda adalah pemenuhan kewajipan undang-undang berkaitan dengan pengurusan pelaksanaan hak, selaras dengan kewajipan yang terkandung dalam Peraturan Perlindungan Data Umum (General Data Protection Regulation). 

Menangani pertanyaan, permintaan dan aduan yang mungkin anda buat melalui saluran Khidmat Pelanggan. 

Bergantung pada sebab anda menghubungi MANGO dan/atau WT FASHION, dasar sah untuk pemprosesan data anda mungkin berbeza. Oleh itu:

• Kami menganggapp bahawa pengguna mempunyai kepentingan sah untuk menyelesaikan dan menjawab dengan betul mana-mana cadangan, pertanyaan, dan permintaan yang anda buat melalui saluran Khidmat Pelanggan dengan pemahaman bahawa, dalam apa jua keadaan, hak dan/atau kebebasan anda tidak akan terjejas atau diganggu oleh fakta bahawa kami sedang menjawab permintaan yang dimulakan oleh anda.

• Dalam kes di mana data anda diproses untuk menangani aduan yang dihantar melalui saluran Khidmat Pelanggan, asas sah untuk pemprosesan data anda adalah pemenuhan kewajipan undang-undang yang terkandung dalam Undang-undang Am untuk Pembelaan Pengguna dan Pengguna (General Law for the Defence of Consumers and Users).

Selepas penyampaian salah satu perkhidmatan kami, kami akan menghantar tinjauan kualiti kepada anda yang bertujuan untuk mengetahui pendapat dan tahap kepuasan anda dengan hubungan anda dengan MANGO dan WT FASHION. Maklumat yang dikumpulkan daripada tinjauan tersebut akan membolehkan kami mencipta dan memperbaiki perkhidmatan dan prosedur kami, pengalaman tersebut adalah sangat penting bagi kami. 

• Asas sah untuk pemprosesan data anda adalah kepentingan yang sah. Kepentingan sah kami adalah untuk menjamin bahawa laman web/aplikasi kami selamat, dan untuk membantu pengguna data memahami keperluan, jangkaan, dan tahap kepuasan anda dengan jenama, dan oleh itu meningkatkan perkhidmatan kami pada setiap masa. Semua tindakan ini akan dilakukan untuk meningkatkan tahap kepuasan anda dan menjamin pengalaman melayari dan membeli-belah yang unik, melalui analisis agregat.

Perkhidmatan carian kedai Mango. Dalam kes di mana anda berdaftar dengan akaun anda, Mango akan memproses data peribadi anda untuk menyediakan perkhidmatan ini, dengan menunjukkan kedai-kedai terdekat dengan alamat yang anda masukkan secara manual dalam enjin carian yang disediakan untuk tujuan ini di kedua-dua laman web dan aplikasi. 

• Asas sah untuk pemprosesan lokasi anda untuk tujuan ini adalah kepentingan yang sah. Kepentingan sah kami terdiri daripada keupayaan untuk menyediakan perkhidmatan yang diminta dengan cara yang paling tepat dan pantas, dan seterusnya meningkatkan perkhidmatan yang kami sediakan melalui laman web/aplikasi kami. Semua tindakan ini dilakukan untuk meningkatkan tahap kepuasan anda dengan produk dan perkhidmatan yang ditawarkan oleh MANGO. 

Untuk menjamin bahawa data peribadi adalah sesuai, relevan dan terhad kepada apa yang diperlukan untuk tujuan pemprosesannya, MANGO dan WT FASHION akan menyimpan data peribadi anda hanya untuk tempoh yang munasabah diperlukan untuk memenuhi tujuan ia dikumpulkan, dengan mengambil kira keperluan untuk menjawab isu-isu yang dibangkitkan atau menyelesaikan masalah, membuat penambahbaikan, mengaktifkan perkhidmatan dan memenuhi keperluan undang-undang yang berkenaan. Ini bermakna kami mungkin menyimpan data peribadi anda untuk tempoh yang munasabah, termasuk selepas anda berhenti menggunakan perkhidmatan MANGO dan WT FASHION dan/atau berhenti menggunakan laman web/aplikasi. Selepas tempoh ini, data peribadi anda akan disekat dalam semua sistem MANGO untuk tujuan tunggal menjadikannya tersedia kepada pihak berkuasa yang berkenaan bagi menangani sebarang tanggungjawab pentadbiran atau undang-undang yang berpotensi dan pelaksanaan atau pembelaan terhadap aduan. Setelah tempoh penyekatan data peribadi berlalu, ia akan dipadamkan secara kekal.

Data peribadi anda hanya akan disampaikan kepada pihak ketiga untuk mematuhi sebarang kewajipan undang-undang yang mungkin terpakai dalam setiap kes, sebagai contoh, kepada Pihak Berkuasa dan/atau Badan Awam apabila diperlukan oleh undang-undang yang berkenaan.

Dalam kes di mana anda membuat pembelian di laman web atau aplikasi kami, data anda mungkin akan disampaikan, di mana berkenaan, kepada institusi kewangan dan penyedia perkhidmatan pembayaran, organisasi pengesanan dan pencegahan penipuan, serta pembekal logistik, pengangkutan, dan penghantaran barang. Komunikasi tersebut adalah diperlukan untuk menjamin penghantaran pesanan anda.

Anda juga dimaklumkan bahawa MANGO atau WT FASHION mungkin akan berkontrak dengan pihak ketiga yang akan mempunyai akses kepada data anda sebagai hasil daripada pembekalan perkhidmatan kami. Pihak ketiga tersebut mungkin menyediakan perkhidmatan teknologi, pemasaran, dan pengiklanan, antara lain, dan dalam semua kes akan memproses data anda mengikut arahan MANGO atau WT FASHION dan tidak sekali-kali untuk tujuan mereka sendiri.

MANGO atau WT FASHION tidak boleh, dalam apa jua keadaan, menjual data peribadi anda kepada pihak ketiga.

Dalam beberapa perkhidmatan yang ditawarkan melalui laman web/aplikasi, seperti Kad Hadiah, pengguna (i.e. pemberi hadiah) mungkin akan memberikan maklumat peribadi penerima hadiah (i.e. penerima hadiah). Dalam kes ini, MANGO dan WT FASHION juga akan mematuhi kewajipannya mengikut peruntukan yang terkandung dalam undang-undang perlindungan data, dan memprosesnya hanya untuk tujuan yang diberikan kepada kami.

Laman web/aplikasi menggunakan teknologi keselamatan data seperti firewall, prosedur kawalan akses, dan mekanisme kriptografi untuk menghalang sebarang akses yang tidak dibenarkan kepada data dan menjamin kerahsiaan data, serta melakukan audit keselamatan berkala untuk menjalankan penilaian risiko dan kawalan yang kerap. Untuk mencapai matlamat tersebut, pengguna bersetuju bahawa MANGO akan memperoleh data untuk tujuan pengesahan kawalan akses.

Selain itu, semua transaksi melalui laman web/aplikasi akan dilakukan melalui sistem pembayaran yang selamat. Butiran pembayaran sulit dihantar secara terus dalam format yang dienkripsi (SSL) kepada entiti yang berkaitan.

MANGO mengisytiharkan bahawa ia telah mengambil semua langkah teknikal dan organisasi yang diperlukan untuk menjamin keselamatan dan integriti data peribadi yang diprosesnya, dan untuk mencegah kehilangan, perubahan, dan/atau penggunaan yang tidak dibenarkan oleh pihak ketiga.

Anda mempunyai hak privasi berikut, yang boleh dilaksanakan melalui alamat e-mel personaldata@mango.com. Bagi memproses permintaan anda untuk melaksanakan hak anda, kami mungkin meminta anda untuk menyediakan bukti identiti anda.

Dasar privasi ini akan sentiasa tersedia. Walau bagaimanapun, dalam kes di mana kami mengubah kandungannya secara substansial dan ketara, kami akan memberitahu anda melalui laman web/aplikasi atau ke alamat e-mel anda, bagi mematuhi kewajipan makluman yang terkandung dalam GDPR dan PDPA di Malaysia.  

Akibatnya, jika anda mahu, anda boleh menggunakan hak anda sebagai subjek data.

Polisi ini dikeluarkan dalam versi Bahasa Inggeris dan Bahasa Malaysia selaras dengan keperluan bahasa tempatan di bawah Seksyen 7(3) PDPA. Sekiranya berlaku percanggahan atau ketidakpersetujuan, versi Bahasa Inggeris akan digunapakai.
